Administrative legality does not always match field reality

A villa that looks good on the surface may not have clean legality. Conversely, a building with old documents may no longer match its current built condition. This is why property due diligence cannot stop at "there is a land certificate" or "there is an old IMB."

For villas in Canggu and Badung, owners or prospective buyers need to examine three layers: zoning, PBG/IMB, and SLF. Zoning answers whether the building's function aligns with spatial planning. PBG/IMB discloses the basis of technical approval. SLF proves the building is fit for use.

Check zoning first

RDTR Badung data in the JKK repository cites Badung Regent Regulation 9/2021 as one of the references for the North Kuta/Canggu area. Issues such as tourism zones, mixed-use, residential, or LP2B determine whether a commercial villa function is realistic to process.

This is essential before buying or renting out. A building may appear ready for operations, but if the zoning does not support the business function, the permit process can become far more difficult. Checking zoning early protects buyers from the risk of acquiring an asset that is difficult to legalize.

Check the PBG/IMB and as-built condition

The PBG or IMB document must be compared against the building's current condition. Is the number of floors the same? Is the built area the same? Has the function changed from a residence to accommodation? Are there additional rooms, pools, commercial kitchens, or public areas?

If the condition has changed, the old document may no longer suffice. This is where as-built drawings and technical assessment help. Consultants do not just check "whether there is a document or not," but whether that document still reflects the building as it stands today.

Check the SLF and its validity period

A business-function SLF is valid for 5 years under PP 16/2021 Article 297 paragraph (2). For villa buyers, the SLF expiry date matters because renewal will require periodic inspection. Do not just ask whether an SLF exists; ask when it expires and whether any changes have occurred since it was issued.

If the SLF is nearing expiry, the cost and time of renewal need to be factored into the transaction. If no SLF exists yet, the buyer needs to understand whether the building can go through the existing route or requires remediation first.

Foreign investors must exercise extra caution

For foreign investors, reading property legality requires greater care because ownership structure, business permits, KKPR, environmental approvals, PBG, and SLF are all interconnected. PP 28/2025 data in the JKK repository serves as a reminder that risk-based business licensing does not stand alone.

Such changes require the document status to be re-evaluated, not just viewed from the existence of an old IMB.

Once documents are gathered, check the physical condition of the building. Are the number of rooms, area, building mass, pool, kitchen, service area, and access still the same as in the old documents? Is there any floor addition or change in spatial function? These questions help determine whether the case is simple enough or requires a more complete technical assessment.
