Architect Sanctions: From Warnings to Revocation of STRA

The architect in charge of PBG bears legal responsibility. UU Arsitek and Pergub Bali regulate sanctions ranging from warnings to the revocation of STRA and Lisensi.

A signature that carries responsibility

Architectural design does not stop on paper. The architect who signs as the party in charge of the PBG submission drawings bears professional responsibility for the reliability of the building they design. UU 6/2017 Pasal 22 details the obligations of the architect, including practicing in accordance with the code of ethics, performance standards, and prioritizing safety.

Therefore, choosing an architect is not just about who can draw quickly. There are legal consequences if design negligence causes problems during both construction and building utilization.

Sanctions at the national level

UU 6/2017 Pasal 38 regulates administrative sanctions for architects who violate performance standards, progressively: written warning; temporary suspension of architect practice; suspension of Surat Tanda Registrasi Arsitek (STRA); and/or revocation of STRA. The same details are also emphasized in PP 15/2021 Pasal 57 ayat (1).

For the most severe violations, UU 6/2017 Pasal 12 states that STRA is revoked if the architect has the status of a convict in a case of architect malpractice or commits a severe violation of the professional code of ethics. The revocation of STRA practically nullifies the right to sign permitting documents.

The second layer in Bali: Provincial Lisensi

In Bali, there is an additional layer. In addition to the national STRA, the architect in charge of PBG must hold a Lisensi Arsitek Provinsi Bali (Pergub Bali 34/2023). Violations of the Lisensi provisions, including negligence regarding the compatibility of the work with spatial planning and local Bali architectural guidelines, are subject to separate sanctions.

Pergub Bali 34/2023 regulates Lisensi sanctions progressively: written warning (Pasal 18), suspension of Lisensi (Pasal 19), to revocation of Lisensi (Pasal 20), which can be accompanied by blacklisting. Thus, an architect in Bali faces two frameworks simultaneously: STRA at the national level and Lisensi at the provincial level.

Why this protects building owners

The standardization of these sanctions ultimately protects consumers. Law-abiding architects will refuse to sign designs that violate regulations, as their own Lisensi and registration are at stake.

For property owners, this means ensuring that the project is guided by an architect whose Lisensi and registration are active is not a trivial detail. This is a layer of protection to ensure your permitting documents stand on a legal and accountable foundation.
