Understanding SBKBG
For developers of apartments, condotels, or multi-unit commercial buildings in Bali, issuing individual unit ownership certificates is a primary commercial target. Permen PUPR 12/2024 introduces Surat Bukti Kepemilikan Bangunan Gedung (SBKBG), a proof of building ownership that is separate from land ownership.
SBKBG contains building ownership data, address, land rights status, PBG number, and SLF number. For multi-story commercial buildings, ownership can be split per unit into Satuan Unit Bangunan Gedung, with each unit having its own SBKBG, the issuance of which requires attaching the Akta Pemisahan.
SLF is an Absolute Requirement for SBKBG
This is where many developers get tripped up. Permen PUPR 12/2024 Pasal 12 ayat (1) emphasizes that SBKBG is issued for buildings that already have an SLF. The sequence is clear: PBG, then construction, then SLF, and finally SBKBG.
If the process goes smoothly, the SBKBG is printed at most 1 working day after the SLF is issued, free of charge (Pasal 12 ayat (5) and (6)). However, if the master SLF is delayed due to structural, mechanical-electrical, or fire protection compliance issues, the entire process of splitting unit certificates for buyers will also grind to a halt.
Why Developer Cash Flow Is Affected
Since SBKBG depends on the SLF, delays in the master SLF directly impact the handover of unit legalities to buyers. For developers, this can mean held-up payments, financing, or subsequent processes that rely on proof of ownership.
Therefore, preparing the SLF in parallel starting from the final phase of construction is essential. A precise technical audit conducted early on helps mitigate the risk of compliance findings that could delay the issuance of the master SLF.
Do Not Forget the SLF Cycle
SLF for business buildings is valid for 5 years according to PP 16/2021 Pasal 297. If the SLF expires and is not renewed, PP 16/2021 Pasal 302 stipulates serious consequences, including the invalidation of the SBKBG and the revocation of public utility services until the SLF is re-obtained.
For commercial building owners, this means that keeping the SLF valid is part of maintaining complete evidence of building ownership. Renewal should not be handled at the last minute, because it still requires a periodic inspection and technical documents.
