SBU & SKK: Legal Requirements for Construction Services
Contractors are required to have an SBU and their workers must hold an SKK. The Construction Services Law (UU Jasa Konstruksi) regulates fines, suspensions, and even blacklisting for violators.
Two certificates that determine legality
For property owners, choosing a contractor should not be based solely on the cheapest price. The legitimacy of a construction business entity is regulated to ensure building reliability. There are two key documents: Sertifikat Badan Usaha (SBU) for companies, and Sertifikat Kompetensi Kerja (SKK) for workers.
UU 2/2017 Pasal 30 paragraph (1) requires every construction services business entity to possess an SBU as proof of its classification and capability qualification. Meanwhile, Pasal 70 requires every construction worker to hold an SKK, and both service users and providers are obligated to employ certified personnel.
Sanctions for those who ignore the requirements
These regulations have teeth. UU 2/2017 Pasal 90 regulates sanctions for business entities performing construction services without an SBU, in the form of administrative fines, temporary suspension of construction service activities, and/or blacklisting.
For parties employing workers without an SKK, Pasal 99 paragraph (2) imposes administrative fines and/or the temporary suspension of construction service activities. Blacklisting is a serious risk as it can disrupt the continuity of a contractor's business in subsequent projects.
Connection to PBG/SLF processing
Since building reliability depends on the competence of its executors, SIMBG requires uploading the competency certificates of project persons in charge. Technical documents prepared without certified experts risk being rejected during the licensing process.
For owners, verifying the contractor's SBU and the experts' SKK from the very beginning is a form of protection. Legitimate contractors are typically more administratively organized, which facilitates the PBG and SLF processes in the future.
Consultant legality as an example
As a consulting business entity, JKK holds an active construction services SBU for architectural services and building construction engineering classifications, and is registered as a member of a consultants' professional organization. Its supporting team of experts holds an SKK in relevant fields.
Such credentials are not just for display. They are a requirement to ensure that technical documents submitted to SIMBG have a valid and accountable foundation of competence. When choosing a partner, make sure to ask about their SBU and SKK, not just the price.
