Inspection & Construction Supervision in Accordance with PBG
Once the PBG is issued, construction implementation is supervised by inspectors through gradual inspections. Non-compliance can lead to stoppage by the Technical Agency.
PBG is not the end of supervision
Obtaining the PBG is not the finish line. During construction implementation, development must run in alignment with the technical drawings approved in SIMBG. To supervise this, PP 16/2021 recognizes Building Inspectors, namely competent persons assigned by the government to inspect building implementation (Pasal 1 angka 34).
One common misconception needs to be clarified: the supervision of construction implementation is regulated under PP 16/2021, specifically in the construction implementation and supervision section, not under Permen PUPR 22/2021 which governs building data collection. They are two different topics.
Inspections are conducted in stages
The duties of the inspector during the construction period are regulated in PP 16/2021 Pasal 236, namely to check the compliance of construction implementation against the PBG and construction safety regulations. Inspections are conducted at critical points.
Pasal 265 ayat (3) details the inspection stages: substructure or foundation works; basement works; superstructure works along with architecture, mechanical, electrical, and plumbing; and the testing and commissioning stage. Inspections are conducted at most 3 working days after the Technical Agency receives the schedule information from the applicant (ayat (4)).
If non-compliance is found
When the inspector finds implementation that does not comply with the PBG document or construction safety regulations, they are authorized to issue a warning to the building provider (PP 16/2021 Pasal 236 ayat (8) huruf e) and report it to the Technical Agency (Pasal 267 ayat (1)).
The authority to stop construction does not rest directly with the inspector, but rather with the Technical Agency. Pasal 267 ayat (4) dan (5) stipulates that if the owner does not make adjustments or does not reapply for the PBG, the Technical Agency can halt construction implementation until the issue is resolved.
Also relevant for renovations and modifications
This supervision mechanism does not only apply to new buildings. Major renovations or modifications that require a modified PBG are also within the scope of supervised implementation, so existing building owners also need to understand it.
